Terms and Conditions
These Terms and Conditions ("Agreement") are entered into between Talentlabs Limited, a company operating TechJobAsia, an online job board (referred to as "Company," "we," or "us") and the users of our services (referred to as "User," "you," or "your") in accordance with the laws of Hong Kong Special Administrative Region ("Hong Kong Law"). By accessing or using our services, you agree to be bound by these Terms and Conditions.
1 Scope of Services
1.1 Company provides an online job board platform that connects job seekers with potential employers. We facilitate the posting, searching, and application for job vacancies, as well as the exchange of information between job seekers and employers.
1.2 Our services may include, but are not limited to, job listings, resume database access, communication tools, and other features related to job search and recruitment.
1.3 We reserve the right to modify, suspend, or terminate any part of our services without prior notice. We are not liable for any loss or damage resulting from such modifications, suspensions, or terminations.
2 User Obligations
2.1 By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement.
2.2 You agree to provide accurate, complete, and up-to-date information when creating an account or using our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3 You understand and acknowledge that the information provided by employers and job seekers on our platform is their sole responsibility. We do not guarantee the accuracy, completeness, or legality of the information provided by users.
2.4 You agree to use our services in compliance with all applicable laws, regulations, and these Terms and Conditions. You shall not engage in any activity that may disrupt or interfere with the proper functioning of our platform.
3 Job Listings and Applications
3.1 Employers are solely responsible for the accuracy, completeness, and legality of their job listings. We do not endorse or verify the authenticity of job listings, and we shall not be held liable for any loss or damage arising from reliance on such listings.
3.2 Job seekers are solely responsible for assessing the suitability of job opportunities and employers. We do not guarantee the availability, quality, or outcomes of any job opportunity, and we shall not be held liable for any loss or damage arising from job seekers' interactions with employers.
3.3 By submitting an application for a job listing, you authorize us to share your application materials with the respective employer. We do not guarantee that your application will result in an interview or employment.
4 Intellectual Property Rights
4.1 Our platform and its content, including but not limited to text, graphics, logos, trademarks, and software, are protected by intellectual property laws. You agree not to reproduce, modify, distribute, or create derivative works based on our platform without our prior written consent.
4.2 By posting content on our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of providing our services.
5 Limitation of Liability
5.1 To the maximum extent permitted by Hong Kong Law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or goodwill.
5.2 Our liability for any direct damages shall be limited to the fees paid by you, if any, for the use of our services during the six months preceding the event giving rise to the claim.
6 Indemnification
6.1 You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or related to your use of our services, violation of these Terms and Conditions, or infringement of any third-party rights.
7 Termination
7.1 Either party may terminate this Agreement at any time for any reason by providing written notice to the other party.
7.2 Upon termination, your access to our services will be terminated, and you shall cease all use of our platform.
8 Miscellaneous
8.1 These Terms and Conditions constitute the entire agreement between you and the Company regarding your use of our services and supersede any prior agreements or understandings, whether oral or written.
8.2 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8.3 The failure of either party to exercise any right or remedy provided in this Agreement shall not be deemed a waiver of such right or remedy.
8.4 This Agreement shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of laws provisions. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.
By using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any provision of this Agreement, you should not access or use our services.
